You don’t necessarily have to have a patent or a trade secret to be successful with a new product – although it doesn’t hurt.
But one thing you must do is make sure you have the legal freedom to operate.
That producing and selling your product doesn’t infringe on someone else’s patent.
Remember, a patent is not a right to practice. A patent is a right to exclude,
And you need to know that someone else hasn’t established that right for themselves.
Get a good solid evaluation done and if you uncover any references that raise questions, get a legal opinion.
